"BUSTER" BALDWIN, Commissioner Pct. 1 JONATHAN LETL, Commissioner Pct. 3 DAVE NICHOLSON, Commissioner Pct. 4 ABSENT: WILLIAM "BILL" WILLIAMS, Commissioner Pct. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 2 On Tuesday, May 11, 2004, at 11:30 a.m., the regular meeting of May 10, 2004, of the Kerr County Commissioners Court was continued in the Commissioners' Courtroom, Kerr County Courthouse, Kerrville, Texas, and the following proceedings were had in open court: P R O C E E D I N G S JUDGE TINLEY: Let me call back to order the regular Commissioners Court meeting originally posted for Monday, May 10th, 2004, at 9 a.m. That meeting was recessed at approximately 3 p.m. on Monday, May the 10th, to be reconvened this morning, Monday -- or Tuesday, May the 11th, at 11:30. It's now a couple minutes after 11:30. It's my understanding that the item to be brought forward on the agenda this time is Item Number 4, that being consideration of the final plat for Hermosa in Precinct 4. I have received notification from the County Attorney's office that the issue concerning the letter of credit is no longer an issue; that the County Attorney has approved that letter of credit, and -- and that's fine with him. The other issue had to do with whether or not the calculations that the engineer made were done on the -- on the two- or five-year frequency. Let the record further reflect that we've just been joined by Commissioner Letz, so we're all present, with the exception of Commissioner Williams. Mr. Motley just came in. MR. MOTLEY: That's correct. JUDGE TINLEY: Okay. COMMISSIONER NICHOLSON: I talked to Franklin Johnston this morning, and he told me he'd -- the engineer for Mr. Vlasek had been in contact with him and sent him documents that reflected that the floodplain design -- or the rainwater design was based on a five-year interval, not the two-year interval, and that that was acceptable to Mr. Johnston. JUDGE TINLEY: I gather that we're going to be receiving some sort of a corrected document, or that the County Engineer -- Mr. Vlasek has something in-hand here. Let the record reflect that Mr. Franklin Johnston just joined us. I believe this is your category -- this is your bailiwick -- COMMISSIONER BALDWIN: I wore mine out yesterday. JUDGE TINLEY: -- talking about people that are timely or not so timely. Commissioner Baldwin, do you care to weigh-in on this? COMMISSIONER LETZ: Is this the final, or does Franklin have another one? And the reason -- MR. VLASEK: That should be what Franklin received. COMMISSIONER LETZ: I mean, I'm not going to be picky; I know it's probably -- but I think there ought to be a copy in the file that's initialed with the handwritten changes, as opposed to just -- it changes the document, but -- JUDGE TINLEY: 5 there, 5 there -- okay, COMMISSIONER LETZ: Yeah. MR. JOHNSTON: That's the way it was delivered to me. It had a couple of handwritten -- some of them were typed. I guess he overlooked a couple. COMMISSIONER LETZ: I think if Mr. Vlasek were to get the changes initialed and get it back to Road and Bridge -- so it doesn't look like some third-party made the changes. JUDGE TINLEY: Okay. COMMISSIONER LETZ: Considering the grief we get over drainage issues occasionally up here. (The motion carried by unanimous vote.) JUDGE TINLEY: All opposed, same sign. The motion does carry. Are there any further items to be brought forward that were not resolved yesterday, gentlemen?
