NOTICE OF PUBLIC HEARING
COUNTY OF KERR
TEXAS COMMUNITY DEVELOPMENT PROGRAM
CO1~~rfUNITY DEVELOPMENT FUND PROJECT
Kerr County is considering a proposed amendment to its approved 2002 Texas
Community Development Program (TCDP) contract with the Office of Rural Community
Affairs. This amendment will exclude: 1}projects completed prior to contract being
implemented due to eminent threat to health, safety and welfare of the citizens; 2) Walk
Bridge in Flat Rock Park.
A public hearing concerning the proposed amendment is scheduled to be held Monday,
10:00 a.m., July 12, 2004, in Ken County Commissioners Court, 700 Main Street,
Kerrville, TX 78028. The purpose of this public hearing will be to discuss the proposed
amendment and solicit citizen input on the proposed change in the scope of the TCDP
project.
A11 citizens are encouraged to attend this public hearing and present their views. The Kerr
County Courthouse is accessible to the disabled; disabled individuals who might have
difficulty in attending this public hearing, or who might require a translator should
contact the County Judge's office to arrange far special assistance. If you cannot attend,
written comments maybe submitted and will be accepted by the County until this public
hearing is concluded.
..... A copy of the proposed amendment is available for review during normal business hours
at the Courthouse. For further information concerning the County's 2002 TCDP project
and/or this proposed contract amendment, please contact County Judge Pat Tinley at

RESOLUTION
-" A RESOLUTION OF THE KERR COUNTY COMMISSIONERS COURT AUTHORIZING
THE SUBMISSION OF A CONTRACT AMENDMENT REQUEST FOR THE COMMUNITY
DEVELOPMENT FUND CONTRACT N0.718257 BETWEEN KERB COUNTY AND THE
OFFICE OF RURAL COIvfiVf[1NITY AFFAIRS.
WHEREAS, the County of Kerr entered into a contract with the State of Texas for funding
under the Fiscal Year 2042 Texas Community Development Program.
WHEREAS, Kerr County completed some activities prior to signing the contract because of the
eminent threat to health, safety and welfare of the citizens of Kerr County.
WHEREAS, Kerr County is not able to complete the Walk Bridge in Flat Rock Park before
expiration date of Federal Emergency Management Contract.
WHEREAS, Kerr County completed the approved activities under budget.
THEREFQRE BE IT RESOLVED BY THE COMMISSIONERS COURT OF KERR
COUNTY, TEXAS.
I . That Commissioners Court authorizes a contract amendment request to be submitted to
Texas Community Development Program for exclusion of the following activities:

Kensing Road
Witt Road
Silver Creek Road
Spanish Oak Road
Engineering for Drainage Projects
Walk Bridge in Flat Rock Park
2. That Commissioners Court designates the County Judge as its Chief Executive Officer to
execute all necessary documents as may be required to initiate and process this contract
amendment request for Fiscal Year 2442 Texas Community Development Program
Contract No. 718257.

In accordance with Section 16(D) of all TCDP Contracts, the above-mentioned Contractor
Locality certifies that this request, as identified in the Budget (Exhibit B}, meets ali of the
following conditions:
The cumulative dollar amount of the contract as outlined in Section 4(C} is reduced by 26%,
because of reasons set forth in Section 4(A} 6 Z3< 7.
The reduction of funds wilt not change the scope or objective of the projects funded through
TCDP contract.
REASON: 1. Some activities caused an eminent threat to health, safety and welfare of the
citizens of Kerr County and were completed before the contract was signed.
2. The Walk Bridge in the Park could not be completed before the FEMA
contract deadline. It will be completed with Kerr County Funds at
a later date.
3. Same projects were completed under budgeted amount.
