TAX COLLECTION AGREEMENT STATE OF TEXAS }( COUNTY OF KERR )( Pg 1 of 2 Whereas, the KERR COUNTY EMERGENCY SERVICES DISTRICT NO. 2 has the power and authority with reference to Subchapter C and Subchapter E of Chapter 775, Texas Health and Safety Code, to authorize the KERB COUNTY TAX ASSESSOR-COLLECTOR to act as the Tax Assessor/Collector for KERR COUNTY EMERGENCY SERVICES DISTRICT NO. 2. Now, therefore, for the consideration hereinafter expressed and the mutual conditions hereof; it is mutually agreed by and between the KERB COUNTY.EMERGENCY SERVICES DISTRICT NO. 2, a political subdivision of the State duly organized and existing under the laws of the State of Texas, and KERR COUNTY, as follows: TERM. This contract shall begin on October 1, 2004, and shall remain in effect unless terminated as provided herein below. TAX COLLECTIONS. The KERB COUNTY TAX ASSESSOR-COLLECTOR agrees to collect Qn behalf of the KERR COUNTY EMERGENCY SERVICES DISTRICT NO. 2, all ad valorem taxes, penalties and interest due, or which may become due, or which may become due to the KERR COUNTY EMERGENCY SERVICES DISTRICT N0.2 during the time this contract is in effect, and in addition, delinquent taxes, penalties and interest for taxes assessed prior to this contract. THE KERB COUNTY TAX ASSESSOR-COLLECTOR shall prepare and mail all tax statements; provide monthly collection reports as well as daily and weekly reports upon request to the KERB COUNTY EMERGENCY SERVICES DISTRICT N0.2; maintain both current and delinquent tax rolls; and develop and maintain such other records and forms as are necessary or required by law or State rules and regulations. RECORDS. The KERB COUNTY EMERGENCY SERVICES DISTRICT NO. 2, without further cost, shall at any time be permitted to inspect and copy all records, including appraisals, assessments, bills, statements, computer tapes, aad any and all other material in the possession of the KERB COUNTY TAX ASSESSOR-COLLECTOR in any way pertaining to the billing and collection of KERR COUNTY EMERGENCY SERVICES DISTRICT N0.2 taxes, penalties and interest. In the evem of the termination of this Contract, the KERR COUNTY EMERGENCY SERVICES DISTRICT NO.2 shall be entitled to have all such records and materials, or copies thereof; turned over to KERB COUNTY EMERGENCY SERVICES DISTRICT N0.2. TERII~IINATION. Either party may terminate this Contract as of October 1 of any calendar year by giving written notice as such termination prior to July 1 of that calendar year. COMPENSATION. The County, as compensation for the obligation assumed hereunder, shall be paid one percent (1 %) of the current and delinquent ad valorem KERB COUNTY EMERGENCY SERVICES DISTRICT NO. 2 taxes, penalty and interest actually collected on behalf of the KERB COUNTY EMERGENCY SERVICES DISTRICT NO. 2. __ ~ ~ Pg 2 of 2 REMITTANCE OF COLLECTIONS. THE KERB COUNTY TAX ASSESSOR COLLECTOR shall remit all taxes, penalties and interest collected for the KERR COUNTY EMERGENCY SERVICES DISTRICT NO. 2, less compensation to the County, to the offices of the KERB COUNTY EMERGENCY SERVICES DISTRICT NO. 2. The County shall provide an itemization showing all collections and adjustments with the remittance. Remittance shall be made weekly when receipts on hand exceed $2,500.00. When receipts on hand are less the $2,500.00, remittance will be made . monthly. DEPOSIT OF COLLECTIONS. KERR COUNTY EMERGENCY SERVICES DISTRICT N0.2 will provide the KERB COUNTY TAX ASSESSOR-COLLECTOR appropriate bank deposit forms with which the KERB COUNTY TAX ASSESSOR-COLLECTOR will automatically make remittance deposits to the account of KERB COUNTY EMERGENCY SERVICES DISTRICT N0.2 as receipts accumulate according to the above paragraph. DELINQUENT TAXES AFTER TERMINATION. After expiration of this Contract, the Kerr Country Tax Assessor-Collector shall furnish the KERR COUNTY EMERGENCY SERVICES DISTRICT NO. 2 an itemization of all delinquent taxes, penalties and interest, and Kerr County shall have no fiuther obligation to collect same.
