"Rusty" Hierholzer Instructions for certification of unopposed candidates: To initiate the cancellation process, the authority responsible for preparing the ballot must certify the unopposed status to the authority responsible for ordering the election. In a city election, this authority is the city secretary. In other elections, the authority is the secretary of the political subdivision's governing body or, if the governing body has no secretary, the presiding officer of the governing body. This document is filed with the presiding officer of the political subdivision. The governing body must meet, accept this certification, and issue an order or ordinance declaring the election cancelled and the unopposed candidates elected. The candidates may take the oath of office on or after the date of election, and the certificate of election should be issued after election day. To complete the cancellation process, a copy of the order or ordinance canceling the election must be posted on Election Day at each polling place that would have been used in the election. An election may be cancelled if: 1) Each candidate (for full or unexpired terms) whose name is to appear on the ballot is unopposed; 2) The election is one in which a declaration of write-in candidacy is required; and 3) No proposition is on the ballot. In an election in which any members of the governing body are elected from single- member districts, an election in a particular district may be cancelled if the candidate is unopposed and the election otherwise meets the above requirements (i.e., there is no at-large candidate opposed on the ballot and/or no proposition). The election would continue in the normal manner for the remainder of the political subdivision. Note: It is not necessary to preclear the cancellation of an election under Section 5 of the Voting Rights Act according to the U.S. Department of Justice.
