AMENDMENT TO THE KERRVILLE/KERR COUNTY/INGRAM EMS INTERLOCAL AGREEMENT The following amendment of the EMS Interlocal Agreement by and between the City of Kerrville ("City"), the County of Kerr ("County") and the City of Ingram ("Ingram") is hereby agreed to by all parties, on the date reflected below. The parties acknowledge the existence of an agreement between Kerr County and Kimble County EMS whereby Kimble County agrees to provide ambulance service, both emergency and transport to Kerr County residents in the extreme northwest portion of the county, in a service area described and delineated on the attached Exhibit A, and commonly known generally as the "YO Ranchlands" subdivision. Upon receipt of a call for EMS service in this area, the Kerrville dispatch service will forward such calls to Kimble County, which will then be responsible for dispatching Kimble County EMS and any First Responder for the area included in Exhibit A. The parties agree that within this described service area, Kerrville EMS shall have no duty to respond pursuant to this Agreement. Any response by Kerrville EMS that may occur pursuant to any Interlocal Mutual Aid Agreement between Kerrville and Kimble County will be at the direction of and on behalf of Kimble County EMS. As discussed previously, Exhibit A to the contract amendment is slightly different than the original map that the Commissioners Court approved, in that the southern boundary of the area to be removed from Kerrville's service area now proceeds along the property lot lines separating the Y. O. Ranchlands Subdivision from adjacent properties, rather than the arbitrary straight line along that map boundary, as was reflected by the previous map. I provided the Ingram City Attorney and City Clerk with this revised map prior to their council meeting at which the contract amendment was discussed, and asked them to see that the Ingram City Council was made aware of this change before they considered the amendment for approval. The Kerrville City Council approved the amendment with the updated map. Once those protocols aze signed and executed copies aze distributed to the various interested entities, this should complete the process of changing the emergency services provider in that azea. I am pleased that we could help you make this change in response to your constituents' wishes. I~ (~ -2004 RESOLUTION AUTHORIZING AMENDMENT TO THE KERRVILLE, KERR COUNTY AND CITY OF INGRAM EMS INTERLOCAL AGREEMENT WHEREAS, in an effort to increase the efficiency and effectiveness of local governments, the Texas Legislature enacted Chapter 791 of the Texas Government Code (also known as the "Interlocal Cooperation Act"), which authorizes local governments to contract with one another to provide a governmental function or service that each party to the contract is authorized to perform individually; and WHEREAS, an agreement exists between the City of Kerrville, Kerr County and the City of Ingram whereby Kerrville currently provides ambulance service, both emergency and transport, to Kerr County residents in the extreme northwest portion of the county; and WHEREAS, Kerr County has requested that the City of Kerrville reduce its service area to exclude a portion of Kerr County that it believes can be more efficiently served by Kimble County and a contract air ambulance service; and WHEREAS, the City Council of the City of Kerrville, Texas, finds it to be in the public interest to agree to amend the 1994 City of Kerrville, Kerr County and City of Ingram EMS Interlocal Agreement to exclude this service area; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KERRVILLE, KERB COUNTY, TEXAS: That the Mayor and City Clerk are hereby authorized to execute and attest, respectively, on behalf of the City of Kerrville, an Amendment to the City of Kerrville, Kerr County and City of Ingram EMS Interlocal Agreement, said amendment being attached hereto as Exhibit A and incorporated herein by reference.
