Came to be heard this the 28th day of December 2004 with a motion made by
Commissioner Williams seconded by Commissioner Letz. The Court unanimously
approved by a vote of 4-0-0 to accept the Deed on 0.15 acre Basilio Mungin Survey No.
37, Abstract 249 which is a part of Red Bird Loop Road, in a Warranty Deed from
Northpoint Investors LTD, owners of record.

RE: Proposed conveyance of a portion of Red Bird Loop to Kerr County
Dear Commissioner Williams:
I am writing to follow up on our previous conversation regarding the above
captioned matter. My clients, Northpoint Investors, Ltd., are the owners of the 0.15
acre of land described on the enclosed plat and field note description. Apparently
when Red Bird Loop was constructed, part of the road was constructed over this
piece of land.
My clients are willing to deed this 0.15 acre tract to the County if the County would
like to accept it. Please let me know the County's thoughts on this matter and we
look forward to hearing from you as soon as possible.

KERB COUNTY, TEXAS
Being all of a certain tract or parcel of land containing 0.15 acre, more or less, out of Basilio Mungin Survey No. 37, Abstract No.
249 in Kerr County, Texas; part of a certain 173.09 acre tract conveyed from Belinda Lee Mosty Stanush, et al to Northpoint
Investors, Ltd. by a Warranty Deed with Oil, Gas and Mineral and Water Right Reservations executed the 27`h day of September,
2004 and recorded in Volume 1387 at Page 187 of the Real Property Records of Kerr County, Texas; and being more particularly
described by metes and bounds as follows:
BEGINNING at an unmarked point in the east line of a certain 10.42 acre tract conveyed from Dorothy Carroll to James F.
Pierce, et ux by a Warranty Deed with Vendor's Lien executed the 29'h day of April, 1992 and recorded in Volume 636 at Page
742 of the Real Property Records of Ken County, Texas for the northwest corner of the herein described tract and said 173.09
acre tract and the southerly southwest corner of a certain 11.95 acre tract conveyed from Gil B. Riedel to Clarence Schmidt, et ux
by a Warranty Deed with Vendor's Lien executed the 318` day of January, 1985 and recorded in Volume 310 at Page 625 of the
Real Property Records of Ken County, Texas; which point bears 1947.2 ft. N.89°56'W. from a fence cornerpost, the occupied
northeast corner of said Survey No. 37;
THENCE, with the common line between said ]73.09 and 11.95 acre tracts N.89°49'41"E., 145.58 ft. to a fence anglepost for the
east corner of the herein described tract;
THENCE, along a fence upon, over and across said 173.09 acre tract S.57°31'41 "W., 172.96 ft. to a fence anglepost in the west
line of 173.09 acre tract and said east line of 10.42 acre tract for the south corner of the herein described tract;
THENCE, with the common line between said 173.09 and 10.42 acre tracts N.00°12'37'B., 92.42 ft. to the PLACE OF
BEGINNING.
I hereby certify that this field notes description and accompanying plat
